BAY COLONY CLUB CONDO - DECLARATION AMENDMENTS

Did you get your amendment package?
Did you notice that:
  1. Proxies are not on safety paper.
  2. No random, non-sequential numbers on proxy return envelopes OR THE PROXIES THEMSELVES.
  3. Proxies are to be returned to the Bay Colony Office.
  4. No inner, unidentified envelopes are provided for proxies.
  5. New unit "Information Sheets" with "owners'" signatures are also being requested.
  6. Future amendments to the declaration will only require 241 votes or 37% of the owners.


SEE ANY PROBLEMS HERE?

This amendment procedure is perfectly designed to allow the sort of ballot-stuffing, gerrymandering elections we saw in the past.

if we stand still for this farce, we will see a steady stream of future amendments opening the door to:
  • A flood of special assessments (no more "emergency" requirement.)
  • Much higher dock fees.  (Let the BOD set fees at will?)
  • A really posh and expensive bar at Rec 4.
  • Etc., etc.; insert your own nightmare here...

you want to see negative ? take a walk to the pool area at rec 1 and try and find a table or chair thats NOT filthy. Take off your blinkers and see what is really going on.

If one looks at the second amendment change. It states the present owners will not be affected INTEL their lease is up. What happens AFTER their lease is up? You can only rent for a year before you renew.
We are told that it is over20% now. If this is true, then, when the next lease is up, they WILL BE TOLD TO MOVE and the owner now has a vacant condo. For how long? It could be months, a year or even years sitting there empty.
Here comes Section 8 and the Fair Housing Laws. They have the money to sue our butts off.
WELCOME TO SECTION 8............
This Board has turned down a rental already, without question as to why!
I bet Pete Shelton will get his condo leases renewed.
Be sure to keep track of when his leases come due, and see who is on the waiting list.
It is just another loophole for this board to do things illegally and the residents will never know.

Remember when the dock fees were only $1.50 a foot. Those days will be gone (now that Pete burned his boat, he will vote to increase it).
37% will be easy to get. There is more residents here without boats, so expect increases in the dock fees. Wonder how the yacht club members will feel about the gang now?

With the new amendment changes, we can all expect a big BAR in Rec #2. If it rains, cocktails will be served in the INSIDE BAR!

Do not vote yes on the amendments or we will have SECTION 8 in here.
Just dump the envelop in the garbage!
Do you want to pay $5.00 a foot for your boat?

My guess is, after reading the amendment ballot, that Bev Houston taught them what she promised. If you want the amendments to pass, forge some names. Wait for this outcome.

If the BCC Declaration could be changed with a 37% vote, would the tennis courts survive? They're an expensive luxury enjoyed by a minority and which is paid for by all.

The tennis courts could be changed into a limited common element, paid for by the players. Just like the docks are paid for by the boaters.

There are all sort of interesting possibilities, once the requirements for amending the Declaration are changed.

BCC's next Board will get the increase for the dockage. We will need the extra money because Section 8 renters can't have a boat!
Picture Jim pompous paying $5 a foot for his rust bucket!
I will vote yes for these amendments.

Do not throw the envelope away. Check NO on all 3 amendments.

BCC will have empty condos because the interview committee, Saundra, Rochelle will turn them down and save the space for Pete's rentals.
Always shady doings when these nightmares are on.

Vote how you wish but base your vote on facts...stop with the scare tactics and lies published here and spread in the community. NONE OF THESE AMENDMENTS HAVE ANYTHING TO DO WITH SECTION 8 OR FAIR HOUSING. The board is trying to protect property values and insurance costs which the last 3 or 4 boards disregarded. Don't agree--that's your right.

Changing our Documentation so that 37% of owners can make future amendments to our Doc's would be a nit wit move.

If something is obviously in everyone's interest it will get done. Doc changes to allow re-finance of the Rec bond and dissolution of the Rec District being examples.

Between renting owners (20%+) and boaters there are more than enough votes to kill this. Add to this all the owners who never vote on anything. 75%? Not possible with an honest vote. Any later claim that there was aground swell of support for this turkey is going to be the big lie.

Some of these turkey's WERE ON the last 3 or 4 Boards. You can not pull the wool over the smart ones. We are too savvy about your past blunders.

Jim Pappas and Saundra Zubko should be ousted from ever serving on this board just like Lesley Lombardi was years ago. They are like a deadly cancer, a disgrace to humanity, a thorn to our community. An embarrassment to leadership.
