FLORIDA STATUTES: TITLE XLVI (CRIMES), CHAPTER 817 (FRAUDULENT PRACTICES)
"(4) Any person who willfully and without authorization possesses, uses, or attempts to use personal identification information concerning an individual without first obtaining that individual's consent, and who does so for the purpose of harassing that individual, commits the offense of harassment by use of personal identification information, which is a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
(5) If an offense prohibited under this section was facilitated or furthered by the use of a public record, as defined in s. 119.011, the offense is reclassified to the next higher degree as follows:
(a) A misdemeanor of the first degree is reclassified as a felony of the third degree."

Social Security? Drivers License? Credit card? Bank account? Unlisted phone? Date of birth and mother’s maiden name?
In a February 19 letter*, Bill Delaney, Bay Colony Club Board of Directors V.P., alleges: “Photocopies of your personal information were illegally taken from the office by Saundra Zubko.” Delaney advised: “You need to take immediate action to protect your identity and consider placing a fraud alert and or security block with all of the credit reporting agencies.” *(To see a copy of this letter, click on “BCC 2010 Delaney Letter” under “Links” in the left column.)
1. Is this allegation true? If so;
2. What other BCC owners had information stolen?
3. Who else knew about this theft and when did they know it?
4. Who, besides Zubko, has this stolen information?
5. What action will be taken (immediately and longer term) to prevent future acts like this?
6. Is it really safe to leave keys to my apartment with the office?

6/5/10 Since individuals' personal data was allegedly removed from BCC files without the consent of the individuals, this is a criminal as well as a civil matter. The BOD investigated and apparently confirmed the allegations as true. Since the data was under the safe-keeping of the BCC Association, why hasn't the BOD filed criminal complaints against all those involved?

I think it is awful that you people are going after Saundra after all the hard work she put in with the rec district and an the board!
She's lucky to be still out of jail and if we are lucky that's only temporary and soon to change.
If someone stole info from a bank or hospital would the bank or hospital file charges or would the people who had info stolen be expected to do it?
Why hasn't the BCC BOD taken any action on this???
If BCC were at risk as a result of this stolen info, YES - BCC (or the BOD) would file.
BCC ISN'T at risk; therefore BCC is not under any obligation to file. If the people involved are concerned, it's up to THEM to file on their own behalf.

BCC is at risk of legal actions brought by victims of ID theft.
BCC was negligent in not protecting the confidential information in its care.
Why do you think the desperate scramble to remove the info from BCC files? Closing the barn door when the horse is long gone?
Filing a criminal complaint for which the BOD has ample evidence is free and shows some intelligent responsibility.

You just want the BOD to have egg on its face (rather than your own!) if it doesn't go anywhere. The court would probably laugh it right out the door.
Well Pete it doesn't cost anything to file a criminal complaint and if a bank let there confidential info available for any low-life to steal where would we all be?

Some folks appear to have the impression that this is a "no harm, no foul" incident, however this was an unprecedented attack on the integrity of our association, and as such should be dealt with to the best of the ability of our BOD. To do nothing in an attempt to appease or mollycoddle the few dissenters would be an audacious dereliction of the BOD's responsibility.
For once, BCC has a chance to shut down the illegal activities of Saundra and her cronies. Why isn't BCC going after it? Because this board doesn't want to hear the complaint of "wasting money paying lawyers" again. Each board that is elected hears the same thing, it's little wonder that they would be hesitant to go after Saundra. I think the next election should speak loud and clear when we DO NOT elect any of Saundra's crowd.

Yes, I was one of the 9 (13) neighbors that Zubkco wanted to harass by hiring a Private Investigator (using our money). She said it is public information...then why did she and Sam. George,Harriet,Pete VOTE TO SPEND $5,000 OF OUR MONEY to investigate us if she could have gotten it for nothing or $19.95 over the internet?

Joyous: PLEASE get your facts straight and true - quit twisting information like you always do.
'Our money" (as you put it) did NOT pay for the hiring of the Private Investigator. The down payment was $750 and it was paid for on Pete Shelton's "Paypal" Account - NOT BCC money.
Not to say that BCC might have forked out some later - IF that bunch had got re-elected, but they weren't and it was just Pete's Paypal account that paid out.
What bothers me MORE than anything else, is that NO-ONE will admit to having taken the information (who will believe Saundra when she says "I didn't take it" and who will believe the Manager when she says "I had to pass it over to Saundra"? - one is an owner and the other is simply an employee.
And NO-ONE knows where the hell those papers went and who has them.
Gee….not one person has the fortitude to give their name. Could they be all from the same person

To say that BCC is not at risk for the ID theft is sending a message that the Board is misguided.
Does that Board member speak for the entire Board?
The Association has a duty to protect its residents. The 9 residents, that had their Identity stolen by Saundra Zubko, can or will be affected for possibly …over a life time.
Unscrupulous thieves pay good sums of money to people like Zubko and others who will SELL social security numbers.
I am aware and have a copy of my file, which includes my social security number.

I would be interested to see proof that Pete Shelton paid for the PI on his paypal account. I doubt that it exists. And, he won't show it because he KNOWS it doesn't exist. I'll bet a dollar that if I put in an official records request, I'd see that the Association paid for it. Yet another lie spread by Saundra and her group. It just doesn't make sense, why spend their own money when they are so good at spending ours??
I have been following this motley assortment of comments with a rather cynioal interest.
It seems no matter what's done, it's wrong. There are those now screaming "The evidence has now been destroyed!" because the files were redacted, and those who scream equally loud that the files should have been redacted long before it happened.
They are trying to lay the blame on the poor manager for letting it happen. What about all those OTHER managers in the past that never did it? First there was Chuck, followed by the SIX managers (in ONE year!) that Saundra Zubko hired, followed by Jack Strohm. Not one of those managers did anything to "protect" us. Then we had Donna Turner, who got booted out after only 3 months, followed by a management firm TMG, hired by Saundra - TMG stayed only a couple of months. THEN we had that delightful United Community Management - you would think that THEY would have known to redact the files!
And what about the lawyers? Ron D'Anna never mentioned that it should be done - nor did lawyer John Stevens - in fact, HE was the one that demanded that the manager comply with Saundra's wishes! It took Becker-Poliakoff to say that it should have been done YEARS ago!
What about the armloads of office files that Sam Slota stole in broad daylight? No-one blinked an eye when THAT happened - and who knows WHAT was in THOSE files?
You know, what is happening in our great country is happening right here in this community (on a smaller scale, of course); everyone wants someone - ANYONE! - to do something for them, but they wouldn't dream of getting up off their butts and doing it for themselves.
People simply are too lazy (and maybe stupid?) to look out for themselves. They want someone ELSE to do it FOR them.
There were 8 or 9 files stolen (NOT all 640!). Why don't these people file their OWN complaints? Perhaps the "victims" have assessed the risks and feel comfortable with trusting to the credit-reporting agencies and a daily scan of their banking records to keep on top? Why are those whose files were NOT stolen making such a hullaballoo?
I would say that it should be up to those Board members and a couple other residents whose files were stolen to take whatever appropriate steps they INDIVIDUALLY deem necessary. It's nobody else's business how they handle it.
What Saundra did (bless her black little heart and may she rot in hell!) was wrong - we know that - but WHY did she do it? I think she and her paranoid bunch wanted to do two things - "intimidate" those who dared to run against her Board and secondly, to "find" out who had written those "nasty" informative letters to the community about what her Board was doing behind closed doors. Well, it doesn't take a brain surgeon to know THAT! Rocco Viola wrote some interesting letters, Bev Houston had her "Watchdog" and Charlie Pukit had his BCC "Blog". WHY the others were taken, I don't know - probably sheer maliciousness ...
But the point I'm making is - those who are complaining (IF you're one of the victims) - file your OWN damned complaint (people keep saying it doesn't cost anything) - so DO it! If you DON'T feel like filing a complaint, then THAT TOO should be your prerogative.
If you feel a "group" (or even "joint") filing is necessary for "clout" - then get your act together with those who feel the same is YOU do, but let the others make up their own minds. Joyous can get together with George - you both appear to think alike. After all, this IS America (still ... ) and people are free to do what they want. It is not yet a dictatorship.
I firmly believe that Saundra's little "games" will come back to haunt her BIG TIME and SHE WILL PAY - I like to think that she has pissed off the "Big Guy" upstairs (after all, He DOES keep a ledger) - and He'll make her pay ...

At last someone actually "gets" the message. I was one of the "victims" (actually my husband Gord and I account for TWO of the ID Theft victims).
When it came to light what Saundra Zubko and her cohorts had done, I asked Gord whether we should be concerned. He said, quite vehemently, "NO". We went through this once before just after we moved to Florida in 1988.
At that time, we took charge and:
1. cancelled and shredded about 2 dozen credit cards that we didn't use or need, and
2. consolidated multiple bank accounts in several different banks down to ONE bank for easier managing.
Gord joined the three credit-reporting companies (ie. Equifax, etc.) and got into the habit of checking all bank accounts twice daily online.
We have never had another problem. Oh sure, we've had our share of "phishing" e-mails over the years (who hasn't?) but we know how to handle it.
UNTIL USE IS MADE OF THE INFO THAT SAUNDRA STOLE FROM THE OFFICE, we don't intend to react with a "knee-jerk" reaction. That would be like trying to nail Jell-O to a tree - amusing to watch and impossible to accomplish.
However, IF any use is ever made of that information, we WILL jump - and FAST - and nail SAUNDRA to that tree. Doesn't matter where it comes from, she will pay the price, along with the others who voted in favor. (And you can take THAT "to the bank"!)

Nail Saundra to a tree? For heavens sake, why? Saundra doesn't have anything worth going after. BCC though has lots of assets and is insured. Since BCC failed to protect confidential information, BCC is the one that should pay.
A board of directors too busy forgiving fines,setting us up to be knee deep in dog doo doo, bringing cookies to shut ins and not minding the store? A do LESS than nothing bunch of slackers.
BCC did not fail to protect the files. It was Saundra's fault pure and simple. She wanted them, she got them. All she had to do was get Security to open the door. They would never have questioned her. I think she wanted to protect her butt for all the illegal activities she was engaging in, and use those files as blackmail. That whole crew is resonsible for fraud, bid rigging, harassment, lies, intimidation, vandalism, the list goes on and on. The best message you can send is to NOT ELECT them EVER! It's a nobrainer.
