BAY COLONY CLUB CONDO - DECEMBER 6 MEETINGS- COMMENTARY



Membership Meeting & Amendment Vote 

So, major proposed changes in our BCC Documents managed to rouse a grand total of 38 people from their torpor.  Assuming that at least eight attendees were part of a couple, at most 30 apartments were represented at the meeting.  Whoopee!  4.7% of the owners cared enough to show up at a meeting with major significance. 

Predictably, not enough proxies were returned to reach a quorum.  Plans are to keep shaking the bushes until, one way or another, a quorum is reached and then put through the changes.

  •  Vote!
  •  Or, "somebody" may vote for you...


Board of Directors' Meeting

The only subject drawing your blogger's interest was the unanimous vote to spend $10,809 for ice makers in Recs 2 & 3.  Recalling the undercover 2010 installation of an ice maker in Rec 1, and thinking $5,405 each was a lot to pay for cranking out cubes, we investigated. 

We need not only an ice maker, which will make cubes, but an ice distributor which will cough them into a glass.  Distributors cost about as much as the ice maker itself .  A distributor is required in order to keep your funky neighbors from chilling their beer and wine in the ice bin, fondling the cubes and/or soaking their feet among them.

Nevertheless, we feel the money would be better spent on flowering perennials which everyone could enjoy and which would go further in increasing our property values.  Potential buyers will note explosive displays of bougainvillea sooner than ice makers.  People can drink at 1 & 4 or bring their own coolers with ice to 2 & 3.

Hey Charlie - looks like your gonna get your wish - no chance of "rigging" the election if the lawyers gonna handle it. But I wonder - whats this gonna cost BCC for them to do this? How many people will bother to vote if they have to put postage on the bellot and mail it in?

Well, it's not the ballots to elect BOD members that's going to the lawyer, it's the resumes of those who want to run for the Board. Probably a smart move, since, in the past, people claimed they were shut out of running because their resumes were "lost" by the office.

We'll see what happens in the actual election. Will the ballots be printed on safety paper? Will the return envelopes be randomly and non-sequentially numbered? Stay tuned....

Look around for a change, beyond your own front door, and see the wonderful improvements that have been done by this board. Not to mention the TIME spent by several members doing a job they don't get paid or thanked for. Rather than complaining we might want to see what more they can do to improve our wonderful community. I think the right decisions will be made concerning icemakers and such.

The thing I'd like to see most and the BEST 'improvement' BCC could receive as a Xmas present would be to see the Office staff get a pink slip and get replaced. Yes, the Board DOES work hard - in fact, THEY are doing much of the work that the MANAGER should be doing!
She got rid of Security. She got rid of maintenance. She got rid of pool upkeep. NOW she's delegating dealing with the contractors to the Board members! Bud does Security, Jack does US Lawns, etc.
Just WHAT THE HELL does SHE do to earn her keep???
Can I have her $64,000 job? I could do it a hell of a lot better. I've got good people skills, I'm better organized, and I'd put in an honest 8-hour day for my paycheck. Sorry, I don't have big boobs or a tight tush and my hair isn't blond or long, but aren't we supposed to be paying for BRAINS, not beauty?

Wonderful improvements?????you are kidding aren't you? The crubs are wavy, the new sod is brown. The thing at the bend is a diaster and nobody answers the phone. They are outside smoking. Cocktails anyone?

I was jogging today, and my attention was drawn to the bend. We absolutely have to rake that mess out and put mulch on it.

Short of an expensive survey, the curb is as close as we could get. We made the company measure a fixed distance from the seawall to keep it as straight as possible. The curb machine followed the contour of the asphalt, which may account for some up-and-down irregularities. The height of the curb is 7-8", which may accentuate any slight waviness. We did this with good reason. When we pave the next road, we will have to mill. A retired BCC civil engineer strongly recommended a higher curb so that we could pave over along B-dock much of the existing roadway. This will save us tens of thousands.

The manager has been in constant contact with US Lawns about the grounds. I also followed up with a phone call to them this week to emphasize what the manager told them--we expect this place to green up during growing season. The company indicated that they have had aggressive chinch bug issues, and other problems, but that the grounds WILL green up during the growing season. We are going to hold them accountable for this.

The grounds have been hit hard by chinch bugs. The company has sprayed repeatedly for them and for weeds. Bottom line, they know they have to deliver or be held accountable. Jack, for you to have to "follow up" with US Lawns is a shining example of how inept the manager truly is. Why, at the salary we pay the office staff, does a volunteer board member have to follow up on anything that should be her responsibility alone to handle?! Was she too busy smoking, shopping, or going for happy hour? You just inadvertently verified for yourself with that statement what we residents have known for a long time; the manager is ineffective and useless. Change anyone???

Need any service? Call Jack he is the boss and makes all the decisions. I will tell you one thing and that is he knows nothing about the plants here. He has thrown away thousands of dollars on the changes he has made...........
Remember when it comes to voting next month.
Change is good, we were all told by the manager.
So lets listen to her and change which means her as well.

Scooters and trucks all night are now allowed. The board folded and got scared.
I would like to see a horse in here as an emotional support animal. They can tie it up at the treasurer's front porch. It is allowed now by law. Look it up.

That's right, the scooters and trucks are flooding in here. I can barely get to my car in the morning because there are so many scooters and trucks in the way. But when 2 law firms tell the board that you cannot deny an owner the right to have the kind of conveyance they choose, the question becomes do you continue to enforce the rules and dare someone to sue, or do you drop that risk to save homeowners potentially tens of thousands in defending rules 2 law firms have told us are indefensible?

Great! Mt 25 foot motor home will fit neatly into my reserved parking space and won't stick out any further than the guy with the SUV who has a motorcycle crosswise in front of it.

It's new! It's cool! It will be the most expensive vehicle in BCC, so it's upgrading the neighborhood!

Charlie - your a scream!!! I think I'll save a lot more money by turning in my car and getting one of those Amish horse and buggies. The buggy will fit in MY spot and the horse can be tied to the tree and keep the grass trimmed. If any vehicle can come in here, that's MY choice of transportation.

But there are limits on what kinds of vehicles can be brought in. We have a "nuisance" provision in our by-laws, and we can enforce reasonable provisions in the common areas. So, a horse that craps all over the place--don't think so. A monster truck or Harley, which blows out sliding doors, no way. A gigantic RV--don't think so. Plus, we can make any rules we want to enforce on guests and renters--including motorcycles and truck exclusions--just have to draft up the paperwork and make as an addendum to the rental agreement. Renters are about 1/4 of the community. So there is much that can be done to prevent the havoc that some seem to fear.

Jack, I think your picture must be under "naive" in the dictionary.You, Phil and Bud have individually and together made decisions that have substantially altered our community for the worse. You listen to an attorney who wouldn't know what our documents say if she tripped over them. How many times has she been wrong?? Allowing guests with truck overnight, allowing mopeds in front of units ALONG with bicycles, no controls on the number of renters. I could go on and on. We managed to keep this place "quality" until you weak, know nothing guys got on the board.

The number of renters was just shy of 25% when this board took over. Get your facts straight.

Only a judge can determine the "rightness" or "wrongness" of an attorney.

How much of the association's budget are you will to risk to find out?

The Meeting of Dec. 6th was a total shock. Although the Meeting was noticed legally, the Agenda was illegal.
SIX Motions were introduced and dealt with that didn't appear on the Shgenda.
No effort was made to have the Board vote to add these illegal Motions to the Agenda. They were just introduced out of thin air, voted on and passed unanimously except for the last Motion to reinstate staggered terms for Board members, which failed.
NOT ONE MOTION appeared on the Agenda.
At this point a "transparent" Board went corrupt. And they're running again for re-election.
I don't trust them any more.

We do not know if this is the place to post our concerns. When we arrived from Ohio this week we drove around the complex because when we drove in it seemed like all you could see was red chips all over the place. Then we saw how all the landscaping has been so reduced and missing plants. By the time we got up to the intracoastal, our eyes popped when the PALMS at building #20 WERE GONE!!!!!!!!THESE WERE LARGE XMAS TREES WORTH OVER $3,000!!!! We stopped to asked "what the hell happened". We could not beleive the answer. Jack the new man on the Board had them removed for his new friend a"Nancy" wanted them out. He should be forced to pay for deal.Does he have any idea about money and how much it cost to remove them and how much they were worth. The anonymous on this page talks about the wonderful improvements. It must have been "Nancy"s write-in. I hear she is one of his new found friends, like Shelton and Zubco. Shame on the other board members that let him do this big expensive blunder. We were told to vote for the two new ones from Italy. You can bet on that.
