BAY COLONY CLUB CONDO - NEW ACCOUNTANT?

So, the BOD in its wisdom has picked a new accountant "based on the advice of our auditor."  Isn't this the same bargain basement, bottom dwelling auditor who has over looked so many weird accounting gimmicks and failures in the past?  Anybody know if the June maintenance payment goes to the same old address?

BCC budgets $6,000 for our audit. While the BOD may be happy with the auditor’s performance, BCC owners should demand more than the lame audit we got. “Audited” and “Auditor” is in quotes throughout this blog because of the quality of the product we received.
The purpose of the audit is to protect BCC owners whose money is being reported on. It is supposed to assure us that the BCC Board of Directors are properly controlling and accounting for our $2 million+ in annual maintenance fees.
This 2008 “Audit” doesn’t do it! It’s time to insist the BOD engages an auditor who realizes his responsibility is to BCC owners, not the BOD. Owners need and deserve an audit that highlights problems and suggests solutions, not one that glosses over mistakes and attempts to bury them with “prior period adjustments”.

BAY COLONY CLUB CONDO - DIG WE MUST?

Digging AGAIN between buildings 3 & 4.  New hole, same spot.
OK, but why do they dig into the SAME sinkhole every couple of years?  Is this part of the Hilman Plumbers "Government Jobs" list?   How many times will BCC pay to do the same job?  Why can't it be done right?  Is the shopping center paying part of this (it's their drain water too).  Anybody with some engineering or construction smarts got an answer?  Let's hear from some of the experts!

BAY COLONY CLUB CONDO - APRIL 30 BOD MEETING - COMMENTARY

It was a dark and stormy night, not a lot on the agenda for this meeting and among the no-shows in the audience were most of the folks whose own voice is music in their ears.  So, things moved right along in a fairly civilized fashion.  For all the nitty/gritty details, go to:

 One of the agenda items was adding another (legal) "companion" mutt to our growing dog population.  If I get a note from my chiropractor saying I'm terminally paranoid, can I bring in my Rottweiler and his inseparable companion the pit bull?

BAY COLONY CLUB CONDO - GARDEN SPOT?

BCC a garden spot?  Well, not in front of our place.  They ripped out all the old growth (whatever) and planted some puny bushes.  When first planted there was some nice black top soil around them.  That washed out right away and now it's a patch of scruffy dirt with some rocks.  Weeds plentiful between stops by the the landscape guys.

Why isn't there mulch (keeps the weeds down and saves water) or some ground cover (") around the bushes.  Is this the best our landscaping committee can do?

How about some more bougainvillea?  More butterfly attractants?  Are we Xeroscaping?

BAY COLONY CLUB CONDO - HIRED? FIRED? WHAT'S UP?

There is a considerable amount of turmoil over the out-sourcing of our security and the firing of two long term employees (Steve and Tom).  Oh yeah, then there's the rumor of out-sourcing maintenance.    Your blogger has been tied up in other matters and hasn't had an opportunity to weigh in on this.  However, this article is being posted to provide a forum for owners to weigh in and state their opinion.

It should be pointed out that there doesn't seem to be anything illegal about these actions... "business judgement" you know.  Despite a long and dubious past history the voting owners, in cahoots with the apathetic, non-voting majority, put these turkeys in office... again.  Who's the enemy?  They be us.

Anyway, let's hear it.  No profanity please and keep innuendo moderate unless you have photos to back it up.  Thanks for your participation.

(1)  CORPORATE ENTITY.--
Unpublished Board Approval Spending $15,000 of Our Money
(d)  As required by s. 617.0830, an officer, director, or agent shall discharge his or her duties in good faith, with the care an ordinarily prudent person in a like position would exercise under similar circumstances, and in a manner he or she reasonably believes to be in the interests of the association. An officer, director, or agent shall be liable for monetary damages as provided in s. 617.0834 if such officer, director, or agent breached or failed to perform his or her duties and the breach of, or failure to perform, his or her duties constitutes a violation of criminal law as provided in s. 617.0834; constitutes a transaction from which the officer or director derived an improper personal benefit, either directly or indirectly; or constitutes recklessness or an act or omission that was in bad faith, with malicious purpose, or in a manner exhibiting wanton and willful disregard of human rights, safety, or property.
718.113  Maintenance; limitation upon improvement; display of flag; hurricane shutters; display of religious decorations.--
Violated Consent Order
(2)(a)  Except as otherwise provided in this section, there shall be no material alteration or substantial additions to the common elements or to real property which is association property, except in a manner provided in the declaration as originally recorded or as amended under the procedures provided therein. If the declaration as originally recorded or as amended under the procedures provided therein does not specify the procedure for approval of material alterations or substantial additions, 75 percent of the total voting interests of the association must approve the alterations or additions. This paragraph is intended to clarify existing law and applies to associations existing on October 1, 2008.
718.3026 Contracts for products and services; in writing; bids; exceptions.
(d) At the next regular or special meeting of the members, the existence of the contract or other transaction shall be disclosed to the members. Upon motion of any member, the contract or transaction shall be brought up for a vote and may be canceled by a majority vote of the members present. Should the members cancel the contract, the association shall only be liable for the reasonable value of goods and services provided up to the time of cancellation and shall not be liable for any termination fee, liquidated damages, or other form of penalty for such cancellation.


No competitive bids.  No discussion at an open Board meeting. No vote at an open Board meeting.  But, thank heavens, aren't we all lucky that this got installed just in time for Zubko's Super Bowl party!  

It's certainly a pity that the pre-approved, unpublished purchase of two additional gold-plated ice machines didn't go through.  Somebody's annual income took a hit. 

It sure looks like the 2010 BCC Board of Directors violated:
  • Florida Statutes FS 718.111 (1) (d), FS 718.113 (2) (a) and FS 718.3026 (2) (d)
  • BCC's Declaration of Condominium
  • The legal Consent Order of January 4, 2006

THAT STENCH?  COULD IT BE CORRUPTION?  OH WELL, YOU'LL PROBABLY GET USED TO IT.
